1. Course Bookings
1.1 All bookings are valid for a period of 8 months.
1.2 Following receipt of the fully completed Registration Form, Nexacu will send a course confirmation email to the Client and attendee.
1.3 Clients must pay the course fees and all other fees to Nexacu before attending any course or its participant/s attends the course.
1.4 All prices shown on our website are in Australian Dollars (AUD$) unless indicated otherwise. Prices shown include Australian GST where applicable.
1.5 Email communication: by signing up to any of our courses, the Client agrees to receive email communications from Nexacu regarding its account and bookings, and periodic marketing emails directly from Nexacu only. The Client may use links provided in each email to modify its email preferences or unsubscribe from any further marketing communications. Nexacu will continue to send account and booking related correspondence by email.
1.6 Please contact us before making any travel arrangements such as booking flights to attend a course. Nexacu will not be liable for any client costs incurred where training does not go ahead.
1.7 Pre-payment for future training without booking on a scheduled course will be deemed a Training Credit which is valid for 12 months from date of purchase. Training Credits must be used within 12 months from the date of purchase or they will expire. No refunds will be provided on Training Credit once purchased. A running account of credit is tracked and redeemed through the client’s billing portal.
1.8 Course manuals will be available via the student portal, in protected digital format (called an eBook) or a downloadable portable file format (some courses only).
1.9 Students will have access to their eBook and other materials, via the student portal for up to 48 months from their course date.
1.10 Students who wish to purchase a printed course manual can do so via their student portal at an additional cost. The printed course manual will be printed and posted to the address nominated by Nexacu’s official printing partner. Shipping destinations may be limited to some countries only.
2. Course Training Day
2.1 Nexacu has a strict no smoking policy in their offices.
2.2 Any participant or other person who, in Nexacu’s sole determination, disrupts the orderly progress of the course may be asked to leave.
2.3 The Client must not invite or make any offer of employment to any Trainer or Consultant engaged by Nexacu, and will not accept any such approach or offer from a Trainer or Consultant, except in accordance with the Service Terms.
3. Public Courses Cancellations, Rescheduling and Transfer Policy
3.1 If the Client wishes to reschedule a public training course date, the Client must manage the change via the client portal. Rescheduling is limited to eligible course dates that fall within the booking validity period outlined in Section 1.1 and remains subject to all applicable conditions and restrictions set forth in these terms.
3.2 A reschedule is when an alternate course date is selected including an Undecided date. 
3.3 The Pending List is applied to a Booking when Nexacu reschedules the booking to an Undecided date. 
3.4 The Restricted List  is applied to a Booking when the Client reschedules within forty-two (42) days of the course start date and is subject to the conditions set out in Section 3.7. 
3.5 A booking placed on the Pending List must be rescheduled by the client to an available course date within four (4) months of being added to the Pending List, or within the booking validity period specified in Section 1.1, whichever occurs first. Failure to reschedule within this timeframe will result in the booking being forfeited, and no credit or refund will be provided.
3.6 Nexacu reserves the right to alter or reschedule a confirmed course date when necessary, including circumstances such as Trainer or Consultant illness. In such cases, Nexacu will make every effort to notify the client as soon as possible. At Nexacu’s discretion, the client may be transferred to an alternative course date or placed on the Pending List. If placed on the Pending List, the client must comply with the conditions outlined in Section 3.5 and reschedule their booking through the Client Portal. Any booking previously on the Restricted List under Section 3.4 will be removed from that list. 
3.7 Restricted List conditions for bookings changed within 6 weeks of course commencement:
(a) The client must self-manage their course date via the client portal.
(b) Course dates available for selection are a sub-set of the full schedule offered for a new booking. The Client Portal will display all confirmed sessions within the timeframe outlined in (e). In some instances, no dates may be available. Clients are encouraged to check the Client Portal regularly, as additional confirmed sessions may be added. Nexacu staff have access only to the course dates displayed in the Client Portal.
(c) A $50 (ex. GST) transfer fee applies to any reschedule made within 42 days of the course start date. This fee will be invoiced and is payable immediately.
(d) To avoid the transfer fee, clients may transfer to a same-day remote session (subject to availability) or nominate a substitute participant for the same course. Clients are required to notify administration as soon as possible if they are unwell or unable to attend. Supporting documentation, such as a medical certificate, may be requested.
(e) The client must select a new course date within four (4) months of being placed on the Restricted List, or within eight (8) months of the original course booking, whichever occurs first. Failure to reschedule within this period will result in the booking being forfeited, and no credit or refund will be provided. Clients who are unsure of their next availability to attend should contact administration for assistance. Additional fees may apply.
(f) The rescheduled course may be conducted on a newer version of the software.
 
3.8 If the Client or its nominated participant fails to attend a training course without providing prior written notice to Nexacu (no show), the full course fee will be forfeited, and no refund or credit will be issued. In addition, if the Client or its participant arrives late to a public training course, attendance and course completion will be at the discretion of the Trainer. If the Trainer determines that participation is not feasible due to the late arrival, the full course fee will also be forfeited, with no entitlement to a refund or credit.
3.9 All requests to cancel a course booking must be submitted in writing to Nexacu no less than seven (7) days prior to the course commencement date. 
(a) Cancellations received within seven (7) days of the course start date will incur a fee equal to 100% of the course price.
(b) Cancellations received between seven (7) and fourteen (14) days prior to the course start date will be eligible for training credit only. 
(c) Cancellations received fourteen (14) days or more prior to the course start date will be eligible for a full refund or training credit. 
 
3.10 In the event that a refund is offered, any discount previously applied to the booking will be deducted from the refund amount.
3.11 If the Client has purchased a Nexacu Certification Course Package (e.g. DA-100) and wishes to cancel, written notification must be provided to Nexacu. Cancellations will be accepted for any unattended courses; less any fees incurred by Nexacu for exam credits, provided that at least fourteen (14) days’ notice is given.
 
4. Course Resit Policy
Resits are not provided as a standard entitlement. Participants may request to repeat a course under the following conditions:
(a) Optional resit at discounted rate. Participants may apply to repeat a previously attended course for a fee equal to 50% of the standard course cost, subject to seat availability on the requested date.
(b) Exception for verified quality issues. Requests for a complimentary resit will only be considered where a legitimate quality concern regarding the original training or delivery is substantiated and confirmed by Nexacu’s Quality Assurance team.
(c) General conditions. All resit bookings are subject to availability, applicable scheduling restrictions, and the version of the course or software in use at the time of delivery. Nexacu reserves the right to approve or reject resit applications at its discretion.
5. Payment and Refunds
5.1 The Client has a right to apply for a full refund only when the rescheduling of the course or courses has been made more than once by Nexacu. Nexacu will have no other liability due to changes to the training course date other than those set out in this condition and no other claim for compensation or expenses will be considered.
5.2 We accept payments via card, Visa, MasterCard and American Express, through our portal, and via EFT. More details can be found on your invoice.
5.3 A credit card surcharge of 1.7% + A$0.30 applies to all payments made using MasterCard, Visa, or AMEX. This surcharge is calculated as a percentage of the total invoice amount and reflects the cost of processing credit card transactions.
5.4 By proceeding with a credit card payment, you accept this surcharge as a condition of payment. The surcharge is non refundable and will be applied to the total amount at the time of payment.
5.5 The surcharge rate is subject to change at Nexacu’s discretion to reflect updates in processing costs or regulatory requirements.
5.6 Customers are encouraged to review payment options prior to finalising a transaction. Alternative payment methods are available that do not incur this surcharge.
5.7 This policy complies with the Competition and Consumer Amendment (Payment Surcharges) Act 2016 and other applicable Australian laws regarding payment surcharges.
5.9 For all bookings, continuing access to materials, including eBooks, exercise files and any additional materials, and certificates of attendance after the course date will only be provided once payment is received.
6. Certification Vouchers
6.1 All vouchers must be used by their expiration dates, in Central Time, without exception, and cannot be extended for any reason. All vouchers and retake vouchers expire at 11:59:59 p.m. Central Time on the day of the expiration date.
6.2 Each alpha numeric code may be used to take one exam. Once the exam begins, the voucher becomes void and cannot be reused or reassigned.
6.3 A voucher is not valid if altered or revised in any way and cannot be redeemed for cash, credit, or refund.
6.4 Retake voucher codes will only be issued if you fail the exam. If you pass the exam, a retake voucher code will not be generated or issued.
6.5 Retake voucher codes are generated within 24 hours of failing the exam and cannot be rush processed.
6.6 A retake voucher code will be sent to the email address on your Certiport account in addition to automatically being assigned to your test candidate profile. It will be available to select from within the payment method window when you retake the test.
6.7 The original code purchased, or the generated retake code, once redeemed, will not work for additional testing.
6.8 The retake voucher code can only be redeemed for the exact same exam that was administered in the first failed attempt. You cannot take a different exam with a retake voucher code.
6.9 The retake voucher code will expire, in Central Time, a set number of days after the code is generated. The window to redeem a retake code varies by program. For example, 30 days for MOS exams. This will be a different expiration date than the original voucher code redeemed for the initial exam attempt. Expiration dates on retake codes cannot be extended.
6.10 Support from Nexacu under the program, including access to exam support, resources and our program coordinators, will lapse 12 months from the booking date.
 
7. Changes due to COVID 19
7.1 Time zones. Remote courses will begin at 9 a.m. in the host city which may be different to the city where the student is based. Students will be notified of the hosting city and should make themselves aware of any time difference impacting the local start and end times of the course.
7.2 Manuals. Due to the current environment, printed manuals will not be provided as part of your course. We are working on creating electronic supplemental materials. These will be provided to students in place of manuals.
7.3 Students attending remotely. Nexacu may revise your host city in the lead up to the course date. This may impact the local start and end times of the course for the student.
7.4 Students changing from face to face to remote. Nexacu may revise your host city in this instance. This may impact the local start and end times of the course for the student.

8. Digital and Printed eBooks
8.1 Digital eBooks are not printable, downloadable nor shareable. Sections of text and images are not copyable. This is done to protect the courseware IP that Nexacu has gone to considerable time and expense to produce and update.
8.2 For students requiring a printed eBook, these are available as a paid additional extra. Students are able to order printed eBooks from the Nexacu student portal.
8.3 Nexacu engages a third party print partner to process and despatch all orders for printed eBooks. Orders for printed eBooks will not be processed and despatched by our print partner until paid. Credit card is the accepted method of payment for a printed eBook.
8.4 Please allow the recommended number of business days from payment to receive your printed eBook. Five to seven working days for standard postage and two working days for express postage.
8.5 Express postage can be tracked via your Nexacu student portal.
9. Changes to this Booking Policy
9.1 Nexacu reserves the right to update and alter this Booking Policy at any time. It is the Client’s responsibility to be familiar with the current version. If Nexacu publishes changes to this Booking Policy, the new policy takes effect for each booking made on or after the date the new Booking Policy is published on Nexacu’s website.
